These Terms of Use ("Terms") govern the access or use by you, an individual, of the transportation services, website, content, and related products (collectively, the "Services") made available by ATS Adnan Transport Solution, having its offices in Islamabad, Pakistan ("ATS"), which expression includes its subsidiaries, legal representatives, administrators, successors-in-title, permitted assigns, and affiliates.
These Terms constitute a legally binding agreement between you and ATS. Please read these Terms carefully before accessing or using the Services. If you do not agree to be bound by the Terms, you may not use or access the Services.
Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and ATS. These Terms expressly supersede prior agreements or arrangements with you. ATS may immediately terminate these Terms or any of the Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
Supplemental terms may apply to certain Services, such as policies for a particular event, activity, or promotion, and such supplemental terms will be disclosed to you in connection with the applicable Services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes and period of the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict with respect to the applicable Services.
ATS may amend the Terms related to the Services from time to time. Amendments will be effective upon ATS posting such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.
Our collection and use of your personal information in connection with the use of the Services is provided in ATS's Privacy Policy. ATS may provide a claims processor, an insurer, or any person required under applicable laws any necessary information (including your contact information) if there is a complaint, dispute, or conflict involving you and a transportation provider, and such information or data is necessary to resolve the complaint, dispute, or conflict.
The Services constitute a transport solution that enables users to arrange and schedule transportation services, including school transport, university transport, corporate commuting, intercity travel, and general pickup and drop-off services. These services are provided by ATS's fleet of vehicles operated by trained captains and drivers. Unless otherwise agreed by ATS in a separate written agreement with you, the Services are made available solely for your personal and non-commercial use.
You acknowledge that ATS provides transportation services through its fleet of vehicles operated by professional captains. All transportation services are provided in accordance with applicable laws and regulations of Pakistan.
Subject to your compliance with these Terms, ATS grants you a limited, non-exclusive, non-sublicensable, non-assignable, revocable, and non-transferable license to access and use the website and content solely in connection with your use of the Services. Any rights not expressly granted herein are reserved by ATS.
You specifically agree not, without the prior explicit written consent of ATS, to:
ATS provides transportation services through its fleet of vehicles, including but not limited to school transport, university station-to-station services, corporate employee commuting, intercity travel, and general pickup and drop-off services. These services may be provided directly by ATS or through authorized partners and affiliates.
The Services may be made available or accessed in connection with third-party services and content (including advertising) that ATS does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third-party services and content. ATS does not endorse such third-party services and content, and in no event shall ATS be responsible or liable for any products or services of such third-party providers.
The Services and all rights therein are and shall remain ATS's property or the property of ATS's licensors. Neither these Terms nor your use of the Services convey or grant to you any rights in or related to the Services except for the limited license granted above, or to use or reference in any manner ATS's company names, logos, product and service names, trademarks, or service marks.
To use certain aspects of the Services, you may be required to register and provide certain personal information, such as your name, address, mobile phone number, and payment details. You agree to maintain accurate, complete, and up-to-date information. You are responsible for all activity that occurs under your account.
The Services are not available for use by persons under the age of 18 unless accompanied by a parent or guardian. You may not authorize third parties to use your account. You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes. You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage, whether to the captain, driver, or any other party.
By using the Services, you agree that ATS may send you text (SMS) messages as part of the normal business operation. You may opt out of receiving text messages from ATS at any time by contacting us.
ATS may, in its sole discretion, create promotional codes that may be redeemed for discounts or other benefits related to the Services, subject to any additional terms that ATS establishes on a per promotional code basis. Promotional codes must be used for the intended purpose and in a lawful manner, may not be duplicated, sold, or transferred, may be disabled by ATS at any time, are not valid for cash, and may expire prior to your use.
ATS may provide you with access to pre-paid credit balances that can be used toward Services. Such credits are only valid for use on the ATS platform, are not transferable or redeemable for cash, are non-refundable, and may only be used for certain Services.
ATS may, in its sole discretion, permit you from time to time to submit, upload, publish, or otherwise make available to ATS textual, audio, and/or visual content and information, including commentary and feedback related to the Services. Any content provided by you remains your property, but by providing it you grant ATS a worldwide, perpetual, irrevocable, transferable, royalty-free license to use, copy, modify, distribute, and display such content.
You are responsible for obtaining the data network access necessary to use the Services. Your mobile network's data and messaging rates and fees may apply if you access or use the Services from a wireless-enabled device, and you shall be responsible for such rates and fees.
The Services are provided on an "as is" and "as available" basis. ATS makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Services, or the information, content, or materials included therein.
To the fullest extent permitted by applicable law, ATS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.
You agree to indemnify and hold harmless ATS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan.
